- Introduction These Terms and Conditions (“Terms”) govern all use of the Zephyr Technology website and all purchases of products from us. By accessing our website, browsing products, or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use this website.
- Independence from Apple Inc. Zephyr Technology is an independent reseller of smartphones and consumer electronics. We are not affiliated with, authorised by, endorsed by, or in any way officially connected with Apple Inc. All product names, logos, brands, and other trademarks such as
“Apple”, “iPhone”, “iPad”, and “iOS” are the property of their respective trademark holders. Any use of these marks is purely for descriptive and compatibility purposes and does not imply any partnership or endorsement. - Products We specialise in the sale of brand-new, sealed smartphones and related consumer electronics. We take reasonable care to ensure that details, descriptions, images and prices appearing on the website are correct at the time of publication. Images are for illustrative purposes and may differ slightly from the product delivered due to packaging or regional variations. We reserve the right to:
• Correct any errors or omissions
• Update or change product information
• Withdraw any product at any time - Pricing and VAT (Margin Scheme) Many of our devices are supplied under the UK VAT Margin Scheme. Where this is the case: • VAT is charged only on the margin and cannot be reclaimed by the purchaser.
• Invoices may not show VAT separately.
All prices are in GBP (£) and include VAT where applicable. We may change prices at any time without notice. If there is an obvious pricing error on the website, we are not obliged to supply the product at the incorrect price and may cancel the order and refund any payment taken. - Order Process and Contract Formation When you place an order, you will receive an order confirmation email acknowledging receipt. This email does not constitute acceptance of your order.
A contract is formed only when:
• Payment has been successfully authorised and captured; and
• We have dispatched the goods and sent you a dispatch confirmation email.
We reserve the right to refuse or cancel any order prior to dispatch, including in circumstances of suspected fraud, stock errors, pricing errors, or issues with delivery address verification. - Payment Methods We currently accept payments via: • Stripe (including major debit/credit cards, Apple Pay, and Google Pay)
• PayPal Business
• Any additional Buy Now Pay Later providers we may add in the future (e.g. Klarna), subject to their own approval and checks Payment must be made in full at the time of ordering. We reserve the right to perform additional security checks and to request identification or additional verification for high-value or suspicious orders. - Shipping, Delivery and Risk We dispatch items Monday to Friday (excluding bank holidays) using reputable couriers such as Royal Mail Special Delivery, DPD, or UPS.
• Orders placed before our daily cut-off time (typically 3pm) are usually dispatched the same working day.
• You will receive tracking details once your order has been dispatched.
• Deliveries may require a signature upon receipt.
Risk in the goods passes to you once the order is delivered or signed for at the delivery address provided. If you provide an incorrect or incomplete address, we are not responsible for any loss, misdelivery or failure to deliver. We are not liable for delays caused by couriers, adverse weather, strikes, customs checks, or other events beyond our reasonable control. - Inspection on Delivery We strongly recommend that you inspect the outer packaging upon delivery. If the parcel appears damaged or tampered with, you should:
• Ask the courier to record the damage; and
• Take clear photographs before opening; and
• Contact us as soon as possible with evidence. - Returns and Refunds Our Returns Policy is designed to protect both genuine customers and our business from device swapping, misuse and fraud.
9.1 Change of Mind – Sealed Items You may request a return within 14 calendar days of delivery for a change of mind, provided that:
•The product remains in its original, sealed packaging;
• The device has not been used, activated or registered;
• All accessories, documentation and packaging are present and in original condition.
Once inspected and confirmed, a full refund of the product price will be issued to the original payment method.
9.2 Opened Items Where a device has been opened, we may, at our sole discretion, accept a return if there is a valid reason (e.g. incorrect model or capacity supplied). In such cases, a restocking fee of up to 30% of the product price may be applied to cover: • Depreciation in the resale value after activation;
• Technical inspection and testing;
• Repackaging and administration costs.
We reserve the right to refuse returns of opened devices where there is evidence of:
• Significant usage or wear;
• Physical damage, misuse or neglect;
• Missing accessories or packaging;
• Software modifications (e.g. jailbreaking).
9.3 Faulty Devices and Apple Warranty All new Apple devices are covered by Apple’s standard manufacturer warranty (typically 12 months from activation). In the event of a fault, customers should contact Apple directly via Apple Support, an Apple Store, or an authorised Apple service provider.
We do not ordinarily provide immediate on-the-spot replacements for products covered by Apple’s warranty, and we do not cover damage caused by accidents, liquid ingress, unauthorised repairs or modifications.
9.4 Returns Procedure
You must contact us at support@zephyrtechnology.co.uk before returning any item to obtain return instructions. We may refuse any unsolicited or unauthorised returns. - Fraud Prevention, IMEI Logging and Device Verification We take fraud and device swapping extremely seriously. To protect our customers and our business, we may: • Log IMEI/serial numbers before dispatch;
• Record video or photographic evidence of packaging and serial numbers prior to shipping;
• Apply additional checks to high-value orders;
• Compare the IMEI/serial of any returned device with the original dispatched device.
If a returned device does not match the original IMEI/serial or shows evidence of tampering, parts-swapping or misuse, we may: • Refuse the refund or replacement;
• Return the item to you at your cost; and/or
• Report the matter to the relevant authorities and payment providers (including for chargeback fraud). - Chargebacks and Disputes If you initiate a chargeback without first contacting us to attempt to resolve the issue, we reserve the right to provide all relevant evidence (including IMEI logs, delivery proof and correspondence) to our payment providers and banks. Fraudulent chargebacks or exploitation of buyer protection schemes will be treated as fraud and may result in legal action.
- Warranty Policy Unless expressly stated otherwise, all new Apple devices we sell are covered exclusively by Apple’s manufacturer warranty. We are not responsible for any decision made by Apple in relation to a warranty claim. We do not provide additional warranty or insurance, and we do not cover:
• Accidental or cosmetic damage;
• Liquid damage;
• Damage caused by third-party repairs or unauthorised service centres;
• Software issues caused by user-installed apps or modifications. - Limitation of Liability To the fullest extent permitted by law:
• We shall not be liable for any indirect, consequential, or special loss, including loss of profits, revenue, data or business opportunities;
• Our total liability for any claim arising out of or in connection with your order shall not exceed the total amount paid for that order;
• Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded under applicable law. - Age and Eligibility You must be at least 18 years old and legally capable of entering into binding contracts to place an order with us.
- Intellectual Property All text, graphics, logos, images and content on our website are owned by or licensed to ZEPHYR CORP LTD. You may not reproduce, distribute, or exploit any content without our prior written permission.
- Website Use and Acceptable Behaviour You agree not to misuse the website by knowingly introducing viruses, attempting to hack, scrape or copy large portions of data, or by engaging in any fraudulent or abusive activity.
- Amendments to These Terms We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the website after any changes constitutes acceptance of the updated Terms.
